Udacity processes the provided names and email addresses for the purposes of registering user accounts, communicating with account holders to provide technical support and collect voluntary feedback, and processing certificates of completion for those who successfully complete one of our programs.

__Udacity's role as a controller__: Udacity is the controller of data that is generated by or collected from users of the platform. For example, Udacity decides what information to track with respect to learner performance, how to grade the submitted projects of learners, and other aspects of the skills training program. ### What are Udacity's data responsibilities as a processor versus a controller?

Udacity is committed to protecting personal data with appropriate technical and organizational measures and is certified under the ISO 27001 standard for information security.

__Udacity's role as a processor__: The enterprise client is responsible for upholding the rights of their employees that use Udacity’s learning platform, while Udacity acts on behalf of the client. For example, the enterprise client can add names/emails to the list, delete them, or change them through the enterprise management interface of the platform. Udacity will only process the names and email addresses as instructed by the enterprise client in accordance with the Data Processing Agreement signed by the parties.

__Udacity's role as a controller__: Udacity is the controller of data that is generated by or collected from users of the platform.  Udacity allows users to make data rights-related requests directly through a web-based automated request system.

### What personal data is collected by Udacity?

Udacity collects personal information directly from the users of our learning platform: when they use our services, make a purchase from us, sign up for email updates, upload or post to public forums, submit requests or questions to us via forms or email, and request customer support and technical assistance. 

The types of information we collect include names, addresses, telephone numbers, email addresses, log-in credentials for Udacity account holders, information about purchases or other transactions with us, information about customer service and maintenance interactions with us, demographic information, information provided in connection with an application or admissions process (e.g. educational background, work experience, and prerequisite knowledge), user-generated content uploaded or posted to public forums through the service, and other information a user chooses to provide to us. Udacity uses the following subprocessors to process the personal data controlled by enterprise clients:

In each instance, the location of the processing is in the United States, except for Cloudflare Inc which is in the United States as well as Globally distributed endpoints matching user location.

### Where is the data stored?

Data is stored in cloud storage within Amazon Web Services. Specifically, Udacity stores data in US West 2 located in Oregon.

### How do you honor data subject rights requests?

Our enterprise clients can add, delete, or correct any of the information they share directly on the Udacity platform. Additionally, Udacity is responsible for upholding the data rights of individuals who request access, rectification, erasure, restriction of processing, or portability of their personal data that was generated by or collected from them. Udacity allows individuals to make data rights-related requests directly through a web-based automated request system.

### Is data exported out of the EU? How do you ensure that exported data is appropriately safeguarded (i.e., in view of the Schrems II decision and the invalidation of the Privacy Shield Framework)?

Yes. European personal data may only be exported out of the EU if a valid international data transfer mechanism is employed to ensure that data transferred internationally is appropriately safeguarded. Udacity uses the Standard Contractual Clauses for international data transfer from EU to US.

### Is the data encrypted in transit, at rest, and in storage?

Yes.

### What information security policies protect consumer data?

Udacity is certified under ISO 27001 and 27017. Udacity maintains an information security management system, including robust policies, procedures, and training to protect consumer data.

### What security / organisational measures have you implemented post Schrems II to ensure that data is adequately protected?

The Schrems II decision invalidated the European Commission's adequacy decision for the EU-US Privacy Shield Framework, on which more than 5,000 U.S. companies relied to conduct trans-Atlantic trade in compliance with EU data protection rules. However, the decision upheld the validity of Standard Contractual Clauses provided that sufficient technical and organisational measures are used by the data importer to protect against government access to EU personal data. Udacity relies on Standard Contractual Clauses in combination with strong technical and organisational measures, including data encryption in transit and at rest, to protect data imported to the U.S.

### What is your data retention policy?

Udacity retains learner data until a valid request is received to delete it. This enables Udacity to verify whether a learner has completed a skills training program upon request in the future. A learner can request deletion of their personal information at any time through our web-based automated request system accessible from their Udacity account.

### Why is the data retained indefinitely by Udacity (unless a student requests deletion)? How does this comply with GDPR?

GDPR requires personal data of data subjects to be held no longer than required to serve the purpose for which the data was collected. In the case of learner data, the purpose for which the data was collected was to deliver online skills training programs that provide the technical skills needed for the careers of the future. Unless Udacity receives a valid request to erase the learner data, the learner data is retained permanently. This allows the learner's record of participation and progress in the program to be maintained. If the data were deleted, we would have no record of an individual's completion and performance within the program.

Udacity Connect is an opportunity for eligible students to work together on their Nanodegree program in a shared physical space. Study sessions will be hosted by a Session Lead who will help students plan their weekly learning goals. For students who enroll or join a list to be notified when a spot becomes open in Udacity Connect before June 30th, 2016, the subscription for the first month of Udacity Connect (worth $99) is free provided they enroll when they are notified.

Eligibility Requirements
------------------------

*   Must have been enrolled in a Nanodegree program + UConnect, remain enrolled, and be in compliance with [Udacity's Terms of Use](/legal) throughout attending Udacity Connect sessions.
*   Attendee must own an Android or iOS mobile device.
*   Must be located in the city that UConnect is offered and be able to commute to them.
*   Must be over the age of 13.

Terms
-----

*   Attendee must adhere to Community Guidelines as stated in their Nanodegree Handbook.
*   Attendee understands that if they have more than 2 consecutive unexcused absences, their spot in the program may be forfeited and Udacity reserves the right to unenroll them from Udacity Connect.
*   In the event that an Attendee’s spot in the program is forfeited, the Attendee will be notified.
*   No partial refunds will be given if cancellation or un-enrollment due to absences occur in the middle of a billing period.
*   Attendee must download the Udacity mobile app to attend sessions.
*   In the event that the remainder of your Udacity Connect sessions are canceled, your Udacity Connect subscription for the current billing period will be refunded.
*   Payments made toward Udacity Connect are not eligible for the 50% back program.
*   If attendee is enrolled in multiple Nanodegree Programs, their Udacity Connect subscription will only be canceled after they graduate from or cancel the Program they enrolled in first. Attendee can always manually set their UConnect program to cancel in their account settings.
*   Udacity is not liable for any harm or injuries that occur during these sessions.
*   Udacity reserves all rights to cancel any sessions.

## Terms and Conditions
Udacity, Inc. (“__Udacity__”) offers our valued community members (“__Members__”) the chance to grant discounts to friends and family on the purchase of a new Nanodegree Program. From time to time, Udacity may, at its discretion, grant a benefit or reward (the “__Referral Benefit__”) when Members refer students (“__Referred Users__”), and such specifics of the Referral Benefit will be contained in Udacity published referral program details (“__Referral Program__”). Any Referral Benefit offered under the program details in which you participate will apply to you, and you may not substitute the Referral Benefit accrued for other benefit or rewards offered under separate Referral Program opportunities. The specific Member and the Referred User are collectively referred to as the “__Participants.__”

These terms will be available through our website, [www.udacity.com](https://www.udacity.com) (“__Site__”), and such specific terms, together these Referral Program Terms and Conditions (collectively the “__Referral Terms__”) govern how Participants may earn and use Referral Benefits. By participating in the Referral Program, you agree to the Referral Terms, which are governed by both our [Terms of Use](https://www.udacity.com/legal/en-us/terms-of-use) (“__TOU__”) and [Privacy Policy](https://www.udacity.com/legal/en-us/privacy), incorporated herein by this reference. No Participant is authorized to participate in the Referral Program, if s/he does not agree to the Referral Terms in their entirety. Terms not capitalized herein having the meanings given to them in the TOU. ### ELIGIBILITY
Udacity reserves the right to __(A)__ determine the eligibility of Users for their participation in the Referral Program and __(B)__ prohibit the Users’ participation in the Referral Program at any time. In order to avail themselves of the  benefits/rewards under the Referral Program, the Participants shall ensure compliance with the following:

1. The Member shall have a valid User Account;
2. Member and Referred User each shall be of legal age (18 years or older); and
3. The Participants must be residents of a country that is eligible (where the program is not prohibited by US embargo restrictions, prohibited by local laws or under the Referral Terms).

### EARNING AND SPENDING REFERRAL CREDIT(S)
Participants can earn Referral Benefits subject to the following:

1. The Member shall share the unique invite link or other identification protocol (the “__Invite Link__“) as provided by Udacity or Talkable through the Member User Account with the Referred User via such communication medium as notified by Udacity in its sole discretion, such as email, Facebook, Instagram, WhatsApp or Twitter.
2. If new to Udacity, the Referred User shall create a User Account only through the Invite Link.
3. The Referred User shall (A) subscribe to a qualifying Nanodegree program by paying the applicable fees through their authorized User Account and (B) not cancel their subscription to that Nanodegree program within the refund window or otherwise be removed from that Nanodegree program by Udacity.  The Referred User and the Member may not be the  same individual to qualify, nor both participating on behalf of the same individual.
4. Subject to the Referred User’s compliance with the Referral Terms, the Referred User may receive a one-time use  discount coupon, credit or other benefit, as determined by Udacity from time to time, in the amount, set forth in the Udacity referral Program details (the “Recipient Benefit”) subject to the Limitations and Exclusions set forth in the Referral Terms.
5. Subject to Member’s strict compliance with these Referral Terms, for each Referred User qualifying purchase or subscription (or other qualifying event specified in the applicable Referral Program opportunity), Member will receive gift card code, credit, coupon or other benefit, as determined by Udacity from time to time, subject to the Limitations and Exclusions of the Referral Program.  Referral Benefits may take several weeks after the Referred User subscribes, purchases, enrolls or otherwise satisfies a qualifying event for the Member Referral Benefit to become available to the Member.
6. Member Referral Benefits may be subject to restrictions on use, such as, for a gift card code certain vendor restrictions may apply.  Similarly, for Referral Benefits in the form of credits towards a Member’s purchase of or participation in a Nanodegree program, in the event of a cancellation of the Nanodegree program by the Member there will be no cash refund for credits applied.  Any loss of a Referral Benefit by a Member cannot be replaced by Udacity.
7. Udacity may place a limit on the number of eligible referrals in which a Member may receive the Referral Benefit according to the program details which may change from time to time.
8. The Member Referral Benefit and Recipient Benefit are hereinafter collectively referred to as “Participant Benefits”.

### LIMITATIONS AND EXCLUSIONS ON EARNING AND SPENDING OF PARTICIPANT BENEFITS
__Participant Benefits which may include credit card codes will be subject to the vendor’s restrictions.  Participant Benefits that might include credits for Udacity courses are not perpetual and must be used or the benefits will expire according to the expiration date set forth in the Referral Program opportunity details. (“Expiration Date”).__

Any unused Participant Benefits that remain in a Participant’s account after the Expiration Date are forfeited by Participant and Udacity will have no liability to Participant for any unused and expired Referral Benefit.

- Referral Benefit(s) in the form of credits to purchase a Nanodegree program or Udacity products or services, have no value outside of the Site, are not considered cash, and cannot be redeemed for cash.
- Referred Users are limited to one referral per program (e.g., you cannot receive two Recipient Benefits to a program from more than one individual. In the event that you are invited more than once or by more than one person for the same Nanodegree program, the first referral received and utilized will be the official referral for a given program).
- No Participant Benefit is transferable, for re-sale, barter, or trade, and no Referral Benefit can be applied to past purchases.

- Members Referral Benefits in the form of credits towards Nanodegree programs are subject to our refund policy for the specific Nanodegree Program (e.g., If you cancel within the first 48 hours, any applicable Referral Benefit may be reapplied to your dashboard and you will be able to utilize that Referral Benefit toward the purchase of another Nanodegree Program, provided that Members may only obtain one refund for such referral credit, and are subject to any other restrictions and/or expiration set forth herein).  Referred Users who receive a Recipient Benefit in the form of a one-time use coupon (in the form of a credit towards a purchase of a Nanodegree program or other Udacity product or service) are not entitled to any refund of the Referred User coupon value or amount once that coupon has been redeemed.
- Other restrictions or limitations relating to the Referral Program, Referral Benefits or Recipient Benefits may be included in the specific Referral Program opportunity that is published by Udacity or Talkable, and are incorporated by this reference.

### PARTICIPANT CODE OF CONDUCT
The following list sets forth standards of conduct that you must comply with in order to be eligible for participation in the Referral Program.

- A Member must not send unsolicited commercial emails, “spam”, or bulk email distribution to individuals with whom they are not personally connected. Additionally, any commercial or other marketing communication Member publishes or sends cannot hide or mislead as to the subject matter or sender of the solicitation and must include a means for the recipient to opt-out of such communications. Invite Links should not be distributed via commercial websites (such as coupon websites). Failure to adhere to these requirements, may be a violation of the Controlling the Assault of Non-Solicited Pornography And Marketing (CAN-SPAM) Act of 2003 and/or analogous federal, state, and international laws.
- Federal, state, and international privacy laws govern how and when a Member can collect information on an individual, how a Member can use that information, and when a Member can share that information with others. Members  must comply with all such laws and regulations, including, but not limited to, providing a clear and accurate disclosure to the Referred Users regarding why Member collects any such information and how it is used, stored, and shared. The U.S. Federal Trade Commission (“FTC”) also provides useful information on privacy obligations.  Other restrictions may be applicable under a Member’s local rules or laws and a Member is responsible for knowledge and compliance with such restrictions.
- Members must not send, publish, or share any false, misleading, or deceptive advertising or communications in connection with Members participation in the Referral Program. Such actions violate various federal, state, and/or international laws, including, but not limited to, the regulations and policies promulgated by the FTC.
- When endorsing, or providing a testimonial for, a company, product, or service, a Member must comply with all applicable federal, state, and international laws and regulations. For example, the FTC requires that, if a Member receives something of value (e.g., a free product) in return for Member’s  endorsement/testimonial, Member must disclose in the testimonial/endorsement that Member has received something of value for his/her statement. If the endorsement/testimonial is provided in social media or native advertising, a Member will need to identify it as “Sponsored”, “Ad”, or another disclosure that identifies the paid nature of the statement. The FTC provides guidance on proper disclosures relating to testimonials and endorsements.
- Members  must not send any Invite Links to any children under the age of 13. Additionally, Members must not send or post any Invite Links on any websites intended for, or targeted at, children under the age of 13.
- Members must not create, or enable others to create, fake, fraudulent, and/or unsubstantiated Invite Links (e.g., if Member has never participated in a Nanodegree program, s/he cannot say s/he recommends that Nanodegree program).
- Members cannot use any technology or other automated system, script, or bot to generate Referral Benefit.
- Participants must not, directly or indirectly, do anything to damage, tamper with, or corrupt the operation of the Program, any referral links or code Udacity provides to Participants, or our Services generally.
- Members must not, directly or indirectly, annoy, harass, or abuse any other person through his/her participation in the Program.
- Members cannot refer themselves in order to obtain credits, including, but not limited to, creating multiple Udacity accounts and/or sending a referral to one or more of Member’s  alternate email address(es).
- Participants must comply with all trademark guidelines in connection with any pre-approved use of Udacity logos.
- Participants must not participate in any activity that Udacity determines, in its sole discretion, places Udacity in a bad light, violates Udacity’s Terms of Use or Privacy Policy, or is inconsistent with the intended operation of the Program or Udacity’s Services in general.

Udacity shall be the sole adjudicator in cases of suspected abuse, fraud, or breach of these Referral Terms by  Participants. The Participants shall have no right to dispute her prohibition on participation in the Referral Program by Udacity. The Participants understand and agree that the decision of Udacity shall be final and binding on the Participants in this regard.

### CANCELLATION OF REFERRAL BENEFIT AND/OR PARTICIPATION
Udacity may delay the awarding of any credits, rewards or benefits to you pending validation or investigation of your compliance with our Terms of Use and the Referral Terms. If Udacity determines, in its sole discretion, that you’ve violated any of provisions of the Referral Terms or any of its other policies, or that your participation in the Program violates the spirit of Program and/or puts Udacity in a bad light, you will be removed from the Referral Program and you will forfeit any credits earned up to and including the date of your removal from the Referral Program.

### CHANGES TO THE REFERRAL PROGRAM TERMS AND CONDITIONS OR REFERRAL PROGRAM
Udacity reserves the right to modify these Referral Terms at any time, at its sole discretion, and without notice to Participants. As a Participant, your continued participation in the Referral Program constitutes your binding acceptance of these Referral Terms. If at any time the Referral Terms are no longer acceptable to you, you should immediately cease participation in the Referral Program.The Referral Program is temporary in nature. Udacity reserves the sole and absolute right to change, terminate, suspend or modify all or any part of the Referral Program.

### TAX
The benefits or rewards by Udacity through the Referral Program to the Members may be taxable. State and local tax laws may apply to the Members. __Members are solely responsible for reporting such reward by Udacity on their tax returns and paying any associated tax liability.__

### RELEASE
Udacity, its employees, officers and directors are not responsible or liable for any damages, or economic or emotional loss because of the Members’ and/or the Referred Users’ participation in the Referral Program. Participants releases Udacity, its employees, officers and directors from any and all claims, including claims that acts or omissions by Udacity, resulted in any damages, or economic or emotional loss because of the Members’ and/or the Referred Users’ participation in the Referral Program and/or use of the Referral Benefit.

### INDEMNIFICATION
Participants agree to indemnify, defend, and hold Udacity and its employees, officers, directors, representatives, and agents harmless from and against any and all third-party claims, demands, liabilities, costs, or expenses, including attorney’s fees and costs, arising from, or related to any breach by the Participant of any of the terms and conditions of the Referral Terms or any violation by the Participant of the applicable law.


Referral Program Terms and Conditions

Important Notice for California Residents

Under California Education Code (Section 94874 (f)), Udacity is limited to accepting under $2,500 in fees from California residents for any individual Nanodegree program pursuant to the exemption set forth in the statute. *__Therefore, in order to comply with the California licensure requirements, Udacity will limit paid access to prevent total program costs exceeding this limit.__*

At the end of the paid access period, Udacity will provide, at no charge, a *__grace period of thirty (30) days__* to California students in order to complete any outstanding projects. After the grace period, Students will have continued static access to course content consistent with Udacity’s policies, which means that Students will have access to the existing course content (not updated content) and all of the completed projects, and Students will not have access to student services such as Study Groups, project reviews, mentor or career support services, workspaces, labs, or quizzes.

Based on our data, we estimate that students can complete the program in four (4) months working 10 hours per week.  

All other policies on subscription access shall otherwise be available to California residents.  Please note that this limitation is assessed on a program-by-program basis. This means that if you are subscribed to more than one Nanodegree program, service limitations will only apply based on the start date of each individual Nanodegree program.

(3.3) Internet or Other Electronic Network Activity Information, including browsing history, search history, application access location and information regarding an employee’s interaction with an internet website, application or advertisement, time and geolocation data related to use of an internet website, application or physical access to a Udacity office location.

(3.4) Professional or Employment-related Information, including job related data, maintained as part of the employment relationship that is present in: a job application or resume; an employment contract; a contractor agreement; a performance review; a disciplinary record; photos; biometric data, including imagery of your fingerprint, face, and voice recordings; information from employee expenses; browsing and search history; payroll, equity and benefits related data; internal and external contact information; or information captured from video, audio, systems, or other forms of monitoring or surveillance.

(3.5) Education Information, including information about an applicant’s or employee’s educational background, such as education records, report cards, and transcripts that is not publicly available.

(3.6) Inferences, including any information drawn from any of the personal information categories referenced above to create a profile about an employee reflecting the employee’s characteristics, psychological trends, preferences, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

(4.) Purposes for Collecting Your Personal Information

Udacity collects the personal information identified in Section 3 above for the reasons listed below.

(4.1) To Recruit Employees, including to conduct employment related background screening and checks.

(4.2) To Administer Benefits, such as medical, dental, optical, commuter, retirement and financial planning benefits, including recording and processing eligibility of dependents, absence and leave monitoring, insurance and accident management and provision of online total reward information and statements.

(4.3) To Pay and Reimburse for Expenses, including salary administration, payroll management, payment of expenses, to administer other compensation related payments, including assigning amounts of bonus payments to individuals, administration of departmental bonus pools and administration of stock option payments.

(4.4) To Conduct Performance-Related Reviews, including performance appraisals, career planning, skills monitoring, job moves, promotions and staff re-structuring.

(4.8) To Maintain Your Contact Information, including altering your details across relevant entities within the Udacity group of companies (for example personal, other employment and transferring roles).

(4.9) To Assist You in Case of Emergency, including maintenance of contact details for you, and your dependents in case of personal or business emergency.

(4.10) To Monitor Eligibility to Work in the U.S., which means monitoring and ensuring compliance of employees’ ability to work in the U.S.

(4.11) To Conduct Healthcare-Related Services, including conducting pre-employment and employment-related medical screenings for return to work processes and medical case management needs; determining medical suitability for particular tasks; identifying health needs of employees to plan and provide appropriate services, including operation of sickness policies and procedures; and providing guidance on fitness for travel and fitness for expatriation.

(4.12) To Facilitate Better Working Environment, which includes conducting staff surveys, providing senior management information about other employees, and conducting training.

(4.13) To Ensure a Safe and Efficient Working Environment, which includes Udacity actions relating to disciplinary actions, and code of conduct processes and investigations.

(4.14) To Maintain Security on Udacity websites and Internet connected assets, which includes hosting and maintenance of computer systems and infrastructure; management of Udacity’s software and hardware computer assets; systems testing, such as development of new systems and end-user testing of computer systems; training; and monitoring email and Internet access.

If you accessed and paid for services for the Self-Driving Car Nanodegree Program ("Self-Driving Car ND Program"), your enrollment is bound by the following additional terms and conditions which modify, amend and supplement Udacity's [terms and conditions](/legal). Capitalized terms found herein shall also be as defined in the [terms and conditions.](/legal)

You understand and agree that because the Self-Driving Car ND Program requires some experience in engineering fundamentals, an application process is maintained for students to be included in the Self-Driving Car ND Program. The Self-Driving Car ND Program has a specific calendar of Online Course start times that are not customizable for students. You are not guaranteed entry into the Self-Driving ND Program nor guaranteed a specific start time for the Online Courses. The Online Courses in the Self-Driving Car ND Program are not self-paced and to the extent you are unable to complete the work associated with each segment of the Self-Driving Nanodegree Program you may be asked to disenroll after the completion of a specific segment if you are unable to meet the requirements of the curriculum.

Unlike other Udacity Nanodegree Programs, the Self-Driving Car ND Program does not maintain monthly fee pricing, but is instead structured in three curriculum terms together comprising the introductory level of the Self-Driving Car ND Program. Each term is priced as a flat fee for the period. Pricing may change for each term from time to time between terms.

Enrollees in the Self-Driving Car ND Program have seven (7) days from the first date the Online Course begins in any individual segment to disenroll and request a full refund. Fees paid for the Self-Driving Car ND Program are thereafter non-refundable for that segment. You may elect not to enroll in further segments at your option and the same seven (7) day disenrollment option shall apply to each segment. For the Self-Driving Car ND Program, you may not otherwise access free trial periods, or other general discounts, coupons or credits, unless a program-specific offer is made to you. Udacity and NVIDIA are not responsible for the policies, actions, or inactions of others that might prevent you from applying for or participating in the Scholarship program, and/or claiming the Scholarship if you're declared a Winner.

Participation in this Contest constitutes Participant's full and unconditional agreement to Udacity's decisions in administering the Contest, which are final and binding in all matters related to this Contest. Eligible Program
----------------

Scholarships are solely for the Self Driving Car Nanodegree program offered by Udacity. Any other Nanodegree program offering enrollments with Udacity shall not be eligible for participation in this Scholarship program.

Contest Period
--------------

Nanodegree Program registrants that apply for enrollment in both the Self Driving Car Nanodegree Program and complete the application for the Scholarship Program between September 13, 2016 and September 27, 2016 ("Contest Period") are eligible for the Scholarships awarded herein. Notification of scholarship awards will be sent to Winners on approximately October 12, 2016.

Eligibility
-----------

The Contest is only open to individuals who are:

*   at the time of entry are at least 18 years of age on the date of entry;
*   residents of any jurisdiction in the world that does not otherwise ban participation in the Contest ("Participants").

Employees and officers of Sponsor, advertising and promotion agencies, and all other entities participating in the design, promotion, marketing, advertising, administration or fulfillment of this Contest and their immediate families are ineligible to participate in this Contest. Void wherever else restricted or prohibited by law. Participants' rights and responsibilities may vary by jurisdiction.

Winners may be required to sign, notarize, and return an Affidavit or Declaration of Eligibility, a Liability/Publicity Release and provide any additional information that may be required by Sponsors. Failure to comply with such requirements within the time period stipulated by Sponsors may result in disqualification and selection of an alternate winner.

Entry Submission Conditions
---------------------------

**Only one (1) Entry per Participant per Program during the Contest Period.** Each Participant is limited to one (1) entry for the eligible Nanodegree Program for the entire contest. All requested information in the Nanodegree Program must be completed to enter and to be eligible to win. Participants will be deemed to be the Authorized Account Holder of the registered student account that completes the program. "Authorized Account Holder" is defined as the natural person who is assigned to the registered student account by Udacity, Inc. In the event of a dispute over the ownership of a registered student account, the prize will be awarded to the Authorized Account Holder of the registered student account.

Selection of Winners
--------------------

**Judging Criteria:**

The winners will be selected by Udacity in its sole discretion.

Judges will evaluate each Participants' Nanodegree coursework in eligible Nanodegree programs and select winners based on the below criteria:

*   Prior participation in other Udacity Nanodegree programs
*   Satisfactory completion of the application for the Self Driving Car Nanodegree program
*   Satisfactory completion of the application for the Scholarship
*   Review of the content of all applications for the following Applicants will be evaluated based on the quality and thoughtfulness of their responses. Submissions should incorporate the following elements that the judges will use as criteria when selecting contest winners: Financial Need, Goal Orientation and Desire to Make an Impact, Demonstrated Determination and Diversity of Perspective

The decisions of Udacity are final, binding, and not subject to appeal. Sponsor reserves the right to not award all prizes in its sole discretion if it does not receive a sufficient number of qualified and eligible entries, or otherwise for reasons of force-majeure or causes beyond Sponsors' reasonable control. In the event of a tie, the sole decision for breaking the tie will be the responsibility of Udacity.

Announcement of Winners:
------------------------

Winners will be individually contacted by Udacity and/or its representatives via e-mail addresses and contact numbers provided during application for the program. Sponsor or Udacity may also announce Winners' names publicly.

Additional Scholarship Terms
----------------------------

*   Participants awarded Scholarships ("Winners") shall receive a scholarship sufficient to cover fees paid for the eligible Nanodegree Program and for no additional amounts. If the Winner(s) decides to take-up any other curriculum or training provided by Udacity, whether related to the Program or otherwise, the cost of subsequent Programs will be borne by the Winner(s) themselves and neither Udacity nor Sponsor shall in any way be liable for payment of any such programs or trainings for any of the Winners or participants.
*   Winners may be asked to participate in additional support related to the eligible Nanodegree Program and if requested to do so, such supports shall be provided free of charge.
*   **The approximate value of each Scholarship is Two Thousand Four Hundred Dollars ($2,400). There is no cash equivalent or alternative to the Scholarship. Winners shall not seek any refunds from Udacity for uncompleted Programs or in lieu of forgoing the Program.**
*   The Scholarship is non-transferrable i.e. the Winners cannot transfer their Scholarships to anyone else.
*   Udacity shall not be responsible for any taxes or levies that may be applicable on/charged to the Winners. Winners shall be solely responsible to make appropriate disclosures of their Scholarship to relevant authorities and pay taxes and levies as may be applicable to each of the Winners. Udacity will not provide any tax guidance or advice on this matter to any of the participants and that the participants/Winners must engage independent consultants/advisors to seek any advices in this regard, if any.
*   Sponsors shall not be responsible to re-sponsor the Program for any of the Winners if the concerned Winner is unable to undergo the Program, for any reason whatsoever, or is unable to complete it successfully.
*   Sponsors are not responsible for the Winner's access, participation and usage of the content of the Program or its relevance, suitability or usability for the Winners. The Program shall be governed by the terms and conditions provided by Udacity.

Representations and Warranties/Indemnification
----------------------------------------------

Participants' submissions must be the original work of the Participant, may not have been previously published, and must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. Participant must not have received any other refund or credit for participation in Udacity marketing programs for the eligible Nanodegree, including without limitation, any money back guarantee program. By submitting information to Udacity, Participant warrants and represents that he/she consents to the submission and use and exhibition of the submissions in the manner set forth in these Official Rules and the Terms and Conditions of Use of the Website. Sponsor reserves the right to disqualify any Participant for any reason, in its sole and absolute discretion.

Privacy Notice
--------------

Participants agree that Sponsors may collect, store, share and otherwise use information provided during the registration/application process, including, but not limited to, name, mailing address, phone number, and email address, including for administering the Scholarship program and verifying the Participants' identity, postal address and telephone number in the event an Participant is selected to be a Winner. Except as described herein, Udacity will use Participants' data in accordance with its privacy policy located at [https://www.udacity.com/legal/privacy](https://www.udacity.com/legal/privacy). Participant's information may also be transferred to countries outside the country of Participant's residence, including the United States. Such other countries may not have privacy laws and regulations similar to those of the country of Participant's residence. If a Participant does not provide the mandatory data required, Sponsors reserve the right to disqualify the Participant. Participants have the right to request access, review, rectification or deletion of any personal data held by Udacity in connection with the Contest.

By participating in the Contest, Participants agree that Udacity may post their first name and the first letter of their last name and their designated geographic location. If Participant wishes to opt out of this disclosure, you must send an email to support@udacity.com, identifying your Udacity username and requesting that Udacity either remove you from the Contest.

By participating in this Contest, each Participant agrees that if the Participant is declared a winner, your name may be announced publicly (for example it may be posted on the program's website) and his or her name and image may be used to promote the Scholarship program. Sponsors may also ask Winners to participate in media activities, but such participation is optional.

Nature of Relationship / Waiver of Equitable Relief
---------------------------------------------------

Each Participant hereby acknowledges and agrees that the relationship between the Participant and the Sponsor is not a confidential, fiduciary, or other special relationship, and that the Participant's decision to provide information to Sponsor for purposes of the Contest does not place the Sponsor in a position that is any different from the position held by members of the general public with regard to elements of the Participant's Submission.

Finally, each Participant acknowledges that, with respect to any claim by Participant relating to or arising out of any Sponsor actual or alleged exploitation or use of any Submission or other material submitted in connection with the Contest, the damage, if any, thereby caused to the applicable Participant will not be irreparable or otherwise sufficient to entitle such Participant to seek injunctive or other equitable relief in any way. Some Participants may have additional rights, depending upon their jurisdiction.

Governing Law
-------------

The Contest is governed by the laws of the State of California, excluding its conflict-of-laws principles. The exclusive venue for any dispute relating to this Contest shall be Santa Clara County, California.

Limitation of Liability
-----------------------

To the maximum extent permitted by law, Participant agrees to indemnify and keep indemnified Sponsors at all times from and against all liability, claims, demands, losses, damages, costs and expenses resulting from any act, default or omissions by Participant and or a breach of any warranty detailed herein to the maximum extent permitted by law.

TO THE EXTENT PERMITTED BY LAW, SPONSORS WILL NOT BE RESPONSIBLE FOR LOST PROFITS, REVENUES OR DATA, FINANCIAL LOSSES OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES. IN ALL CASES, SPONSORS WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE THAT IS NOT REASONABLY FORESEEABLE. TO THE EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF SPONSORS FOR ANY CLAIMS UNDER THESE TERMS, INCLUDING FOR ANY IMPLIED WARRANTIES, IS LIMITED TO THE COST OF THE FEES PAID BY PARTICIPANT FOR THE NANODEGREE PROGRAM.

General Liability Release/Force Majeure
---------------------------------------

Participants agree that the Sponsors shall not be responsible or liable for any losses, damages or injuries of any kind resulting from the Contest or any Contest-related activity. Sponsors assume no responsibility for any damage to a Participant's computer system which is occasioned by accessing the Website or participating in the Contest, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. Without limiting the generality of the foregoing, Sponsor is not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged or stolen Submissions or notifications; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet Service Providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Contest or the Website, to be acting in violation of these Official Rules, or to be acting in a disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Contest, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. In the event Sponsor is prevented from continuing with the Contest as contemplated herein by any event beyond its control, including but not limited to fire, flood, earthquake, explosion, labor dispute or strike, act of God or public enemy, or any federal, state or local government law, order, or regulation, or other cause not reasonably within Sponsor's control (each a "Force Majeure" event or occurrence), then subject to any governmental approval which may be required, Sponsor shall have the right to modify, suspend, or terminate the Contest. If the Contest is terminated before the designated end date, Sponsor will (if possible) select the winners from all eligible, non-suspect Submissions received as of the date of the event giving rise to the termination. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Participants may have additional rights, and those rights may vary by jurisdiction and Sponsor will abide by additional terms of those jurisdictions.
